PARtner Loyalty Rewards Program

Effective January 1, 2022

By enrolling in and using the PARtner Loyalty Rewards Program (the “Program”) of Worldwide Golf Shops LLC (the “Company”), you hereby agree to and accept all of the terms and conditions listed herein, as well as all of the terms and conditions of the Company's Privacy Policy, as each of the foregoing may change from time to time in the Company's sole discretion with or without notice to you. Please read our Privacy Policy carefully to understand how we collect, use and disclose information about customers.

Subject to the terms of use contained herein and the Company's Privacy Policy, by enrolling in the Program, members will have the opportunity to earn rewards on Qualifying Purchases (as defined below) made at the Company's websites and store locations. No purchase is required to sign up for the Program, and you may do so online or in-person at any of our store locations. “Qualifying Purchases” means any purchase of any product in Company stores and websites, but does not include the purchase of any PING products, which are expressly excluded from the Program.

ELIGIBILITY AND REGISTRATION REQUIREMENTS.

You must be sixteen (16) years of age or older, a resident of the United States (“US”), and have a US phone number to be eligible to sign up for the Program. Membership in the Program is limited to one account per individual. By enrolling in the Program, you hereby certify that you are at least sixteen (16) years of age or older and that you are a US resident.

There is no annual fee required for the Program. Your full name, a valid email address, US zip code and US phone number are required to enroll. The phone number you provide will be used as the primary method of identifying your Program account either online or in stores. Program members must present or enter their account number or telephone number at check-out of every purchase in order to receive Rewards Points (as defined herein) for that purchase. Only one email address and one phone number per membership will be accepted. Members are responsible for maintaining accurate and updated personal information with the Company. The Company is not responsible for rewards that are not received as a result of loss or if you don't maintain accurate personal information with us and such rewards will not be reissued.

CONSENT TO MARKETING COMMUNICATIONS.

By enrolling in the Program, you hereby consent to receive Program specific marketing, as well as other promotional communications from the Company or the Company's affiliates or service providers by email. We will also communicate with you regarding your Program status and transactions. You may opt-out or unsubscribe at any time by following the instructions in such communication and/or as otherwise provided herein. In order to receive the full Program benefits you must remain opted-in to our general marketing and Program-specific marketing communications via e-mail at all times. To stop receiving promotional emails from the Company, you may use the unsubscribe option and other relevant instructions in any such email. By unsubscribing, you are only opting out of email marketing communications; your Program membership and Rewards Points will not be affected.

REWARDS POINTS.

Upon enrollment, members of the Program will earn 0.02 rewards points on every $1.00 spent on Qualifying Purchases, excluding taxes, gift cards, returns and shipping (“Rewards Points”). Rewards Points may be earned from January 1st through December 31st of each calendar year. Each 1 Rewards Point translates into $1 in rewards dollars (“Rewards Dollars”) (i.e. 1 Rewards Point = 1 Rewards Dollar). Rewards Dollars are redeemable only when a member has accumulated 5 or more Rewards Dollars (i.e. after making $250 or more in Qualifying Purchases) within a single calendar year. There is no maximum amount of Rewards Dollars a member may earn within a calendar year (subject to the limitations set forth herein). Rewards Points and Rewards Dollars earned during a given calendar year cannot be transferred to or rolled over into the following calendar year. From time to time, the Company may offer promotional bonus offers (in addition to the base Rewards Points) whether to a general audience or targeted to specific customers.

Members may redeem Rewards Dollars in the form of an electronic gift card that will be issued by the Company early in the year following the end of a given calendar year (“Rewards Gift Card”). The Rewards Gift Card will be sent to the email address on file for each member of the Program. The Rewards Gift Card will expire at the end of the calendar year in which it was issued by the Company.

By way of example, if a member earns $10 in Rewards Dollars after making $500 in Qualifying Purchases in the calendar year 2022, the member will receive a Rewards Gift Card with a $10 balance in early 2023 that expires on December 31, 2023 at 11:59 p.m. By way of further example, if a member earns less than $5 in Rewards Dollars (i.e. after making less than $250 in Qualifying Purchases) in 2022, the member will not receive a Rewards Gift Card for the 2022 calendar year.

PRIOR MEMBERS OF THE PARTNERSHIP LOYALTY REWARDS PROGRAM.

If you were a member of the Company's prior rewards program, rewards balance and account information have automatically been transferred to the new Program. The prior rewards program will cease to exist effective January 1, 2022 and will be replaced with the Program. While your enrollment in the Program will continue, you will still be required to sign up in stores or online prior to being able to gain full access to the Program's benefits.

PROGRAM SUSPENSION AND CANCELLATION.

The Company may in its sole discretion at any time and for any duration without notice close, suspend or modify the Program and future Program rules, including membership and changing the rate at which Rewards Points are earned or calculated. Updates shall be effective on the date they are posted on the Company's websites, and you agree that such posting constitutes valid and effective notification method and no further notice methods are required; continued use of your Program membership after such date constitutes acceptance of all such changes. Your Program account, membership, and Rewards Gift Card may not be transferred, purchased, sold, assigned, auctioned or traded to any other individual. The Rewards Dollars or Rewards Gift Card are not redeemable for cash. A member may cancel their Program account at any time by emailing marketing@worldwidegolfshops.com. Upon cancellation, any unused Rewards Dollars accrued in your account will be forfeited and cannot be redeemed. Effective suspension or cancellation of the Program will not automatically unsubscribe you from marketing communications.

MISCELLANEOUS.

Members are solely responsible for taxes, charges or other liabilities related to or resulting from their participation in the Program.

If the Company determines that a member has abused any of the Program benefits, fails to comply with any of these terms and conditions, or makes any misrepresentation to the Company, the Company, may, in its sole discretion, take such actions as it deems appropriate, including without limitation, suspending such member's privileges under the Program, revoking any or all of the Rewards Dollars in such member's account with or without advance notice to the member and without liability to Company.

This Program supersedes and replaces in their entirety any prior Company loyalty rewards program(s).

NOTICE OF FINANCIAL INCENTIVE UNDER CALIFORNIA LAW

The Program is a program that gives customers the opportunity to earn points based on Qualifying Purchases. As further described in these Terms of Service for the Program, when you enroll in the Program, you agree to allow the Company to collect certain information from you, including, non-exhaustively, your full name, email, zip code and phone number. Under California law, the Program may be considered a financial incentive provided in exchange for the collection and retention of personal information. While we do not assign a numeric value to the information we collect through the Program, the Company does reasonably benefit from obtaining such information which it uses in accordance with the Company’s Privacy Policy. The Program is an optional program that customers can withdraw from at any time in accordance with these Terms of Service.
